But there are games that had framepacing issues at launch and got fixed with a regular patch later. Shouldnt they be able to fix it with a more powerful hardware?

In all fairness they should fix it without more powerful hardware. But from sucks at the technical bit. They have a great art team, but they kinda suck at the technical stuff.
